A FIFA ESTÁ SE PREPARANDO PARA ABANDONAR AS REGRAS RELATIVAS AOS AGENTES DE JOGADOR / FIFA IS PREPARING TO ABANDON THE RULES RELATING TO PLAYER AGENTS FIFA

Em um movimento que poderia transformar o mercado global de transferência em um mercado livre para todos.

A circular que o departamento técnico da FIFA que rege o futebol mundial distribuiu a todas as suas 208 associações nacionais é a prospecção de um parecer sobre uma proposta que vai retirar-se do seu papel regulador do mercado de transferências internacional. O desenvolvimento foi tratado numa conversa de uma conferência de agentes, em Wembley, ontem, com um delegado alegando que os sinais de movimento que o futebol está indo "de volta para o oeste selvagem".

Nesta altura em que inquéritos criminais estão em curso em ambos os lados do canal, alegadamente sobre atividades ilegais nas transferências dos jogadores de futebol, a proposta já se reuniu com uma recepção muito fria na França. Pois, nesse país, as autoridades legais também regulam os agentes desportivos sob as leis nacionais. O diretor jurídico da federação francesa de futebol, Jean Lapeyre, disse: "Nós vamos deixar claro à FIFA que a nossa posição em relação a este tipo de ideia é hostil."

A postura da FIFA é pragmática. Ela deixou claro que apenas uma em cinco transferências em todo o mundo emprega um agente licenciado e sob a sua direção um membro da FIFA, deu um voto político de remoção desta burocracia que é muito caro e tende a ganhar um apoio considerável.

Atualmente a carga administrativa para agentes reguladores encontra-se com as associações nacionais e até mesmo a pequena nação insular de São Tomé e Príncipe, na costa oeste da África central, tem três agentes licenciados que trabalham a partir de suas margens.

Para as nações de futebol mais importantes, como a Inglaterra, diz que não é um problema ter o Agente Credenciado. Na verdade, a Associação de Futebol tem sido um líder mundial na aplicação da regulamentação dos agentes, trazendo regras adicionais e acordos de licenciamento na sequência do inquérito da Quest sobre as denúncias de "tampões" no futebol.

Aqui no Brasil as autoridades federais não se metem no futebol, corre tudo a céu aberto e sem comando. Nunca ninguém regulou nada aqui, qualquer vendedor de picolé é dono de jogador e qualquer dirigente se torna empresário de jogador, tem clube em que se briga para ser diretor de futebol e botar a mão nos jogadores.

E agora a FIFA quer acabar sua criação, não tenho nada contra, desde que receba por tudo que gastei (antes, pensava que estava investindo), hoje sei que joguei fora este tempo todo e o dinheiro que empreguei, antes pensava que iria ter uma função, exercer um trabalho em que poderia contribuir com a experiência e o conhecimento adquiridos em muitos anos no futebol e que até ganharia para meu sustento, mas que poderia esta ajudando muitas pessoas a terem uma carreira bem administrada. Para isto me tornei um agente FIFA, ou credenciado, só que até hoje não sei de quem nem para que.

In a move that could turn the global transfer market into a free for all.

A circular that the football's world governing body has distributed to all of its 208 national associations is canvassing opinion on a proposal that will see it withdraw from its role as regulator of the international transfer market. The development was the talk of an agents' conference at Wembley yesterday, with one delegate claiming the move signals that football is heading "back to the wild west".

At a time when criminal inquiries are under way on both sides of the Channel over allegedly illegal activities in football transfers, the proposal has already met with a cold reception in France. In that country the statutory authorities also regulate sports agents under national laws. The French football federation's legal director, Jean Lapeyre, said: "We are going to make clear to FIFA that our stance towards this sort of idea is hostile."

FIFA’S stance is pragmatic. It has made clear that only one in five transfers worldwide employs a licensed agent and under its one-member, one-vote policy the removal of costly red tape is likely to gain considerable support.

Currently, the administrative burden on regulating agents lies with the national associations and even the tiny island nation of São Tomé and Príncipe, off the west coast of central Africa, has three licensed agents working from its shores.

For major football nations such as England, that is not a problem. Indeed, the Football Association has been a world leader in its enforcement of agents' regulations, bringing in additional rules and licensing arrangements following the Quest inquiry into allegations of "bungs" in football.

The FA refused to comment on how it will respond to FIFA’s survey. However it is believed privately to be dismayed that the progress it has made in recent years could be undermined.

There is some speculation that FIFA will even forbid national associations from having any involvement in governing the activities of agents, which the FA would certainly resist. However, there is a strong feeling among agents that FIFA’s withdrawal from the regulatory space will be of benefit to world football.

"It would be a blessing if FIFA backed out," said Mel Stein of the Association of Football Agents. "They do nothing, they respond to nothing: the whole regulatory structure is a mess. This is them throwing their hands up, they can't cope."

There is a severe backlog of cases at FIFA. Among them is the FA's complaint about Pini Zahavi's presence at the meeting at which Chelsea "tapped up" Arsenal's then left-back, Ashley Cole. As an agent registered in Israel, the FA has no authority over Zahavi and must rely on FIFA’S role as the international regulator. Yet more than three years since it was given an extensive dossier relating to the incident, FIFA says only that the case is "ongoing".

By contrast, the FA has won praise. "The FA has tried very hard to come to terms with the commercial reality and has done some very good work. It would be a terrible shame to throw the baby out with the bath water," Stein said. He believes that the AFA and its European counterparts would be willing to self-regulate if FIFA does strip back federations' rights to govern transfers.

A FIFA spokesperson said: "FIFA has engaged itself very actively in trying to find a solution to the regulation of international transfers, working together with its member associations and also with the clubs. It is also fair to recall that players' agents are not licensed by FIFA, but by the national associations already since 2001."

De acordo com a revista VI (magazine sobre Futebol na Holanda) a FIFA acabará com a Licença de Agentes Credenciados em 01.01 de 2010. Isso é bom ou ruim?

A razão principal para a FIFA é que em todas as recentes transferências internacionais somente 30% delas, foram realizadas por Agentes Credenciados (popularmente chamados Agentes FIFA), e existem muitas reclamações.

O que nos leva a entender que o nível dos Agentes Credenciados está muito aquém do que a FIFA deseja e tentou instituir. Muitos dos agentes credenciados não têm formação acadêmica, não tem conhecimentos necessários para terem sido licenciados, são aqueles antigos empresários, são aqueles ex-jogadores que não estudaram, não entendem das Leis e os que não estão interessados em mudar sua maneira de fazer seus negócios: não seguem as regras da FIFA e também as próprias Confederações e Federações que não fazem sua parte e sem falar que em certos Países se compra a "carteira" de Agente.

Então, se o mercado do futebol em Países como nosso próprio Brasil e tantos outros Países de 3º. Mundo, não tem o conhecimento destes novos "procuradores" licenciados e regulamentados para exercerem uma função determinada pela FIFA, como se pode trabalhar? Pois é necessário que os clubes e os próprios jogadores saibam para que e por que, foi criada, esta nova “profissão” e para que estes Agentes Credenciados possam realmente exercer esta nova atividade.

Além de tudo tem que ter o apoio e entendimento da sua própria Federação (filiada FIFA no País de origem), CBF no caso do Brasil, para cobrar as novas regras, depois de implantá-las, o que nunca foi feito. Fica muito difícil cobrar uma coisa que inexiste, e mudar as regras do jogo que interessa mais aos que usam desta falta de transparência, para continuar saqueando os clubes, roubando atletas e enriquecendo com a desonestidade e impunidade, mas, quem irá fazer isto (lógico que existem pessoas honestas e decentes), ninguém.

Esta noticia, acabei de receber de nosso escritório na Holanda e também através do site de executivos LinkedIn, espero que a FIFA reconsidere e trate de impor seu desejo, para que possamos ter um futebol íntegro. Que esta notícia possa até ser apenas uma “perua” como se diz no jargão do boleiro, porque se está ruim assim com ela, imaginem sem ela.

Nunca consegui fazer nada, pois simplesmente não existo aqui em meu estado, a própria Federação Pernambucana de Futebol não aceita minha credencial, a imprensa especializada nos trata como "marginais", os clubes simplesmente desconhecem as novas regras e sem falar nos próprios jogadores que nunca tiveram nenhuma informação sobre o que somos e o que deveríamos fazer. E quando se faz, o atleta não paga a comissão devida.

A CBF fica esperando que cada um faça o seu? Então de que adianta esta Licença? Os custos de toda a operação ficaram com quem? Temos que estudar o Estatuto da FIFA; Direito Civil; Leis Trabalhistas, Leis Internacionais, e tantas outras como a Lei Pelé, Lei Zico, Maguito Vilela, Leis Trabalhistas, entender de mercado, marketing, etc. Ir ao Rio de Janeiro prestar o exame, pagar uma taxa, fazer um seguro internacional renovável todo ano, pagar uma carteira da CBF? E para quê? Já que os "empresários" fazem os negócios sem problema nenhum, falei recém com a Advogada da CBF e ela simplesmente falou que a CBF não teria como, proibir tal uso? Ou seja, somente a nós, regulamentados, licenciados e fáceis de ser encontrados e ainda que aceitemos um código "deontológico" e que assinamos um contrato? Poderemos ser "punidos", ou seja, pagamos por querer ser decentes.

A última vez que mostrei a carteira num clube. O porteiro chamou a policia, falando que os dirigentes não queriam “empresários” de jogadores em suas dependências? E olhem que fui assistir a um jogo internacional e sou sócio do tal clube há muitas décadas.

Submeter-se a regras que somente são cumpridas por quem tem a Licença, é uma piada, porque aqui no Brasil as coisas continuam da mesma maneira que antigamente, o dirigente estagiários e o amadorismo assola os clubes, e que servem apenas para cabides de outros interesses que o de gerir um clube profissional de futebol como empresa, com transparência e dentro de uma gestão profissional de acordo com o que rege a International Board da FIFA. E também não poder usar nenhum símbolo da CBF e da FIFA em seu material de trabalho. Como seja,em nosso web site, cartão de visitas, papel de cartas, etc., de que vale então essa licença.

Criaram até uma associação (ABAF), mas temos que pagar para ser sócios? E que também não faz nada para a classe e existe no Rio de Janeiro somente.

E que até o ano de 2001 a FIFA através de seu “staff” fazia os exames e depois passou esta obrigação as Federações Nacionais, mas, continuou impondo suas regras de seu estatuto e de lá para cá, os Agentes FIFA passaram a serem apenas Agentes Credenciados da Federação a que são filiados. Tirando o "status" de Agente FIFA, que era respeitado, na Europa pelo menos.

E para complicar, a própria FIFA estipulou que os Agentes Credenciados deverão prestar novo exame de 5 em 5 anos, (já retirou esta intenção). Mas que na hora de nos atraírem para esta arapuca, explicaram que era uma posição "vitalícia" e que bastava pagar o seguro anual para termos este "direito" de ser Licenciado FIFA.

Também foi explicado que a FIFA e a própria CBF estariam trabalhando para conscientizar todos os envolvidos no esporte e que qualquer clube ou atleta profissional que não usasse o serviço por ela exigido seriam punidos e até cassado sua licença de atleta profissional, e todos nós sabemos que somente o agente Credenciado, o Advogado e os familiares do jogador é que podem representá-lo, como um profissional do futebol (isto valeria para clubes e jogadores).

Mas esqueceram que aqui no Brasil, existe a Lei que garante o Direito Adquirido (que está explicito em nosso material fornecido pela entidade) anteriormente ao exame, e quando uma nova Lei é criada não tem valor retroativo e somente passa a vigorar dali por diante e mesmo que pudesse ser retroativa, a própria Constituição Brasileira e o 

Código Penal garantem que a Lei só retroage para beneficiar.

E que este negócio de empresas alheias ao esporte, poderem comprar e vender atletas pofissionais de futebol, estariam sendo afastados (como na Europa) e  juntamente com os charlatães, empresários, e outros sem comprometimento com estas regras estariam sendo tirados do futebol. Para moralizar o esporte, até hoje esperamos, e nada aconteceu.

Muito há de ser feito, muita água tem de rolar embaixo desta ponte, mas não concordo nesta possível extinção do Agente Credenciado, nestes quase 5 anos em que tenho a Licença (isto em 2009), consegui vivenciar muitos casos em que temos que ter este tal "AGENTE" desde que seja realmente efetivado pelo órgão maior (FIFA) e respaldado pelas Federações Nacionais. E quem não cumprir os estatutos da FIFA, seja banido do futebol profissional.

Do contrário teremos e veremos uma enorme regressão do que se está tentando fazer para moralizar este esporte, onde qualquer um que tenha dinheiro sem procedência segura e certa, pode investir e se dará muito bem (a famosa lavandaria no futebol). Além de que a credibilidade e honorabilidade da FIFA serão questionada e posta em dúvida, e certamente que teremos uma enxurrada de processos ajuizados contra a CBF e a própria FIFA e que cabem sem nenhuma sombra de dúvidas nesta situação.

GERENTE DE FUTEBOL DEVE ACABAR / FOOTBALL MANAGER WOULD END

O grande desafio hoje é encontrar um treinador que faça todas essas funções, porque ele é, atualmente, um profissional mais de campo e o gerente de futebol é um treinador mais de apoio. Para isso, o treinador terá que assumir mais tempo dentro do clube para justamente desenvolver esse papel. O lado bom dessa mudança é que a relação com a diretoria de futebol vai melhorar, porque não existirão mais os intermediários e a comunicação será direta, ou seja, treinador e diretoria, sem a gerência de futebol no meio. Ainda tem o ganho financeiro, porque o clube não precisará arcar com as despesas desse profissional.

Como o treinador nada mais é que um gerente da área de futebol, o trabalho desse profissional ficará ainda melhor, mais importante. A maior prova disso está na renovação de Vanderlei Luxemburgo com o Grêmio/RS. Em seguida a assinatura do contrato essa semana (22/11/2013), Vanderlei iniciou as conversas com a direção do clube para melhorar o elenco da sua equipe para o ano de 2013. Lá no clube gaúcho e ele fez correto, ele mesmo sentou com a direção do clube gaúcho para definir as regras para 2013. Sem intermediários. Isso é gerir uma equipe, seja ela de futebol, seja ela de qualquer outra área.

O treinador deve fazer a escolha na hora de formar a sua equipe, junto com a direção e mais ninguém.

Muito pertinente seu comentário. Entretanto, acho que essa função tende a ser melhor especializada, um Gerente de Futebol cuidaria das divisões de base - de sua estrutura e desenvolvimento -, e também dos contratos ou recomendações de jogadores estando ligado diretamente à presidência. Além, é claro, de fazer o "scout" (procura) dos jogadores profissionais e   das divisões de base, tão relegadas em nosso futebol profissional.

Tal função está distorcida, um Gerente de Futebol não é um “treinador”, nunca foi e nunca deverá ser. Decerto que deve ser uma pessoa com muito entendimento de futebol jogado, mas nunca um treinador, além de possuir a capacidade de articulação e com conhecimento de identificar futuros bons jogadores, entender de valores, de contratos, da burocracia e suas leis, ou seja, do conjunto que rege o Futebol. E por fim, mas não menos importante, ter entendimento de mercado, sobretudo o  internacional.

Não podemos admitir, pelo menos no futebol brasileiro, que um técnico seja aquele que contrata, pois ele ocupa um cargo de extrema incerteza: se perder 4 ou 5 partidas é demitido. E depois como ficarão os jogadores contratados por ele? Outra questão muito relevante é a questão da ética, por exemplo, a comissão/jabá, pagos por fora que os atletas estão sendo obrigados a pagar a alguns para jogar... alguns para fazer testes. Pois, alguns técnicos não estão nem um pouco ligando para sua honestidade ou transparência, o que vale é o dinheiro em sua conta bancária.

Outra coisa é o planejamento de média e longa duração que todo clube profissional deve ter, e quando temos uma verdadeira dança de admissões e demissões na carreira de técnico, não se pode ter certeza de planejamento nenhum.

Então esta função de Gerente de Futebol deve ser melhor vista e repaginada, e locupletada com mais funções pelo clube, dando-lhe o status de "funcionário do clube", com carteira assinada e encargos trabalhistas pagos... Mas, que sejam profissionais, pois, este negócio de colocar um amigo, um conselheiro, ou alguém de sua amizade para ser o tal Gerente de Futebol, esse sim, tende a acabar, pois compromete muito uma administração em um clube profissional e mostra a falta de transparência desta administração. E de preferência que ele tenha sido jogador e que exista uma sinergia e identificação com a instituição. Saudações meu camarada.

However, I think this function tends to be better defined, a Football Manager have to take care of the basic divisions also, its structuring and development, linked directly to the CEO, to make contracts, or at least recommend to the presidency, and is course to scout players, both, professionals and the amateurs (basic divisions, so relegated in our professional football) and can be brought to be worked on and part of the institution's assets.

Besides that, the function is distorted, a Football Manager is not a "coach", never was and never will be. Certainly someone must be very understanding of football played, but never a coach should be a person with knowledge of identifying future good players, also understand the value of contracts, this bureaucracy and the Laws which govern it, must also have knowledge international market and especially what happens in football in your own region.
