O oficial de mídia da FIFA, Alex Stone teve seus 15 segundos de fama na noite de Natal quando ele twittou o seguinte: "processo disciplinar Última de 2012; 1 hora para nós da FIFA: un agente suspendu derramar propos ses." Désobligeants "sur Facebook."

Ele recebeu esta resposta de @ changeFIFA: "AlexStone7 Você faz um ótimo trabalho e sempre muito gentil, que nós realmente apreciamos mas não quero apenas não passar no teste do cheiro.?"

Através da minha vida profissional eu conheci um monte de alexstones que trabalham para a FIFA. Eles são dedicados e fiéis no trabalho, leal para um salário médio padrão e, basicamente, fazem o que é suposto.

Mas o que Alex Pedra não conseguiu passar para seus seguidores no twitter foi como a maneira de Disciplina do Comitê da FIFA chegou a essa decisão.

E eu vou dizer a ele, porque ou ele não sabe ou ele ignorou descaradamente.

RSC Anderlecht apresentou uma queixa por "perjúrio e difamação" em dezembro 2011, o Milan pulou no trem andando, numa fase posterior com os mesmos fundamentos. A Comissão Disciplinar da  FIFA, seu vice-secretário Christine Fariña com muitas horas trabalhadas (possivelmente) a volta do relógio e por um ano inteiro sobre o caso, de uma forma que faria corar qualquer agente de investigação. 

Chamadas de telefones, e-mails, faxes, DHL vigilância, tic-tac, tic-tac, com a precisão do relógio suíço que ela usa em seu pulso. Ela até exagerou seu trabalho - ela corrigiu um desses documentos ilegíveis por fax pelo advogado “estrela” Cantamessa em nome do AC Milan, quando a prática comum diz que ela deveria ter enviado de volta para a tradução adequada. 

Eu podia sentir a idéia: "temos que pegar esse cara '.

Ela e seus colegas na divisão acumularam mais de 180 páginas de chamadas provas - a maior parte em francês. 15 dos meus posts foram analisados, comentados e dissecados por toda parte.

Quando o D-Day chegou, estava tudo pronto. E veio dos juízes - quatro. Um Suíço, um Irlandês, um Venezuelano e um Chinês. Ela levou um mês inteiro para escrever as 31 páginas-decisão deste longo caso, novamente em francês. No final do dia, eu havia sido suspenso por dois meses e multado em 8'000 CHF.

Foi então que meu alarme tocou.

Eu corri para fazer uma verificação rápida sobre os juízes e recebei esta nota de volta:

"Eu gostaria de informar que, a língua oficial do Jim Shaw é o Inglês e ele não fala francês." - Janet Elliot, irlandês FA PA para o Comitê Diretor.

"Tanto quanto sabemos, o Sr. Wei Di só sabe falar Chinês." - Confederação Asiática de Futebol Media.

"Não fala Francês" - twittou @ antoniojqr, um escritório de advocacia confiável de esportes em Caracas (FA venezuelano não retornou uma consulta de e-mail).

Então, aparentemente, apenas um dos juízes - o Suíço Marcel Mathier - fala francês.

Pergunta: como poderia executivos de futebol deste calibre (chefes de suas respectivas associações) chegarem a essa decisão sem ter pleno conhecimento do conteúdo do caso?

Ou foi lhes apresentado na linguagem universaI ... O Esperanto?

É então justo pensar que a decisão é parcial e contaminada, pela mídia oficial do Alex Stone? 

Artigo enviado pelo agente FIFA Paulo Teixeira, eu gostaria muito de divulgar isto em meu Blog. Para mostrar o que se passa com todos os Agentes Credenciados via confederações, toda esta confusão e falta de apoio e suporte ao redor do mundo e não entendo porque ela manda ajuntar questões suas e de seu estatuto, nos exames, se desde 2001 diz que não somos mais Agentes FIFA, e que não temos mais nada com ela, que somos credenciados via confederações, dando a entender claramente que ela está cima do bem e do mal.

Mostra o grau de irresponsabilidade e descaso que tem conosco, com os agentes e com suas Confederações, tente enviar uma mensagem a qualquer um de seus funcionários em qualquer departamento, para ver quando receberá uma reposta, nunca, todos ficam calados (porque já enviei várias, e em sua linguagem oficial, que é o Inglês) e até hoje, nada.

Porque depois de escrever em seu estatuto que o Agente Credenciado seria um cargo vitalício, tentou voltar atrás e até redigiu outro estatuto, querendo instituir um teste de 5 em 5 anos, para reavaliar o conhecimento dos agentes.

Até porque nunca em nenhum momento a FIFA através da CBF legalizou os agentes credenciados no nosso País. E agora querem acabar o monstro que criaram e ainda mais esta, substituir por um programa de computador.

Será que eles na FIFA sabem que estamos falando de pessoas e de suas carreiras que estão em jogo, ou será que a FIFA não reconhece o marketing e o merchandising como uteis e necessários ao jogador. Será que só sabem ver dinheiro, pois isto leva apenas a isto, os clubes ficam “linkados” diretamente à FIFA, e teriam que comprar e pagar, um “pacote premium” de serviços para poder fazer esta busca por jogadores e as transferências, (pergunto em qual língua seria este serviço), porque nem mesmo eles se entendem, tem diretor que não fala a língua universal instituída pelo próprio órgão. 

prezados colegas agentes credenciados, temos sim que nos juntarmos e decidirmos o nosso futuro e o futuro dos atletas que precisam ter representantes capacitados e com conhecimento para ajuda-los em sua carreira, e até a maioria dos clubes que infelizmente aqui no Brasil, sabem muito pouco das regras, e normalmente falam que o clube é uma instituição particular e que a FIFA ou a própria CBF, não mandam em nada.

Vejam que a Inglaterra já o fez, regula sim, a função de Agente FIFA, e outros Países Europeus a estão seguindo, para regular a função do Agente Credenciado como uma função importante na vida de pessoas, de carreiras de jogadores de acordo com a Lei Trabalhista e Lei Civil de cada País, e no caso de transferência internacional regular de acordo com o Tribunal Internacional de Haya. E como qualquer Advogado deve e poderia fazer só que cobram os olhos da cara e aos agentes só é permitido cobrar 10%, além de que, qualquer caso em que se coloca na justiça comum brasileira vira um caso a perder de vista.

Com os agentes credenciados regulados pelo governo, e logicamente, autenticados (como os Advogados o são, vide OAB), iria além de impedir que a lavagem de dinheiro avance mais ainda no mundo dos negócios da bola, os subfaturamentos de valores de atletas, (caixa dois), que saem em duas vias (e às vezes até mais) e muitos e muitos outros casos, que se forem investigados a fundo, nunca se pensaria em entregar isto desta maneira ao mercado do deja vu, ou vocês acham que todas estas empresas e grupos de investimentos em jogadores estão fazendo o que?

Ou alguém acha que na hora que os presidentes de clubes puderem decidir diretamente, entre eles, isto poderá acabar quanta ingenuidade, ou então, está marchando para isto mesmo, deixar a coisa aumentar e com isto a FIFA deve encher mais ainda seus cofres, bem como seus dirigentes.

He got this reply from @changeFIFA: "AlexStone7 You do a great job & always very kind, which we really appreciate. But doesn't that just not pass the smell test?"

Through my professional life I've met loads of alexstones working for FIFA. They're devoted and loyal, work for an average standard salary and, basically, do what they are supposed to.

But what Alex Stone failed to pass to his followers on twitter was the way FIFA Disciplinary Committee reached that decision.

And I am going to tell him, because either he doesn't know it or he has blatantly ignored it.

RSC Anderlecht lodged a complaint for 'perjury and defamation' on Dec 2011, AC Milan jumped on the train at a later stage on the same grounds. FIFA Disciplinary Committee deputy secretary Christine Fariña worked (possibly) round-the-clock for a full year on the case, in a way that would make any investigative agent blush. 

Phones calls, e-mails, faxes, DHL surveillance, tic-tac, tic-tac, with the accuracy of  the Swiss watch she wears on her wrist. She even overdid her job - she corrected one of those unreadable documents faxed in by star attorney Cantamessa on behalf of AC Milan, when common practice says she should have that sent back for proper translation. I could sense the idea: 'we gotta get this guy'.

She and her colleagues at the division piled up  more than 180 pages of so called evidence - most of it in French. 15 of my posts had been  analyzed, commented and dissected throughout.

When D-Day arrived, she was all set. And in came the judges - four. A Swiss, an Irish, a Venezuelan and a Chinese. It took her a full month to write the 31-pages long decision, again in French. At the end of the day, I had been suspended for two months and fined 8'000 CHF.

It was then  my alarm bell buzzed.

I ran a quick check on the judges and got this back:

"I wish to advise that Jim Shaw’s official language is English and he does not speak French." - Janet Elliot, Irish FA PA to Chief Committee.

"As far as we know, Mr. Wei Di can speak Chinese only." - Asian Football Confederation Media.

"No habla frances" - tweeted @antoniojqr, a reliable sports law firm from Caracas (the Venezuelan FA did not return an email query).

So, apparently, only one of the judges - the Swiss Marcel Mathier - speaks French.

Question: how could football executives of this caliber (bosses of their respective Associations) have reached such a decision without having full knowledge of the contents of the case?

Or was is presented to them in the universal language...Esperanto?

Em entrevista ao jornal "Extra", Assis até chegou a admitir a possibilidade de negociar o irmão com outro clube caso o pagamento não seja efetuado até o dia 31 de janeiro

O irmão e empresário de Ronaldinho Gaúcho, Assis, se irritou com o imbróglio existente entre a diretoria do Flamengo e a Traffic, já que ambos os lados ainda não conseguiram se acertar e a empresa segue devendo R$ 3,5 milhões ao meia rubro-negro.

Em entrevista ao jornal "Extra", Assis até chegou a admitir a possibilidade de negociar o irmão com outro clube caso o pagamento não seja efetuado até o dia 31 de janeiro.

"Alguém tem que assumir isso. Que paguem o contrato. Que paguem o salário dele. São cinco meses esperando. Parece que o cara é mercenário. Como isso: se demora cinco meses para receber o salário?Eles (Flamengo e Traffic) precisam se acertar. Mas parece que está difícil. Cinco meses se passaram e nada. E o dirigente (Michel Levy) foi chamar o jogador de marqueteiro. São cinco meses sem receber. Isso não é legal. Foi muito mal ele. Tem Deivid, Alex Silva, sem luva. E aí?", questionou o empresário do jogador, ao jornal carioca.

Este é o retrato puro e simples da maioria de nossos clubes, amadores e não cumprem o acordado. Um futebol feito de mentiras, falsidades, onde não existe palavra e muito menos pagamento. Na hora de aparecer a maioria dos dirigentes fazem de tudo, até baixar as calças, mas depois quando a porca torce o rabo e a verdade vem à tona, é que se vê de que é feito o futebol brasileiro, o real, aquele dos bastidores e comumente só sobra para os procuradores (ou como se chama aqui) “empresários ou agentes”, a imprensa que come e muito jabá, tira sempre os dirigentes desta extremidade.

Manda quem pode, obedece quem tem juízo, e o jogador que vá para a justiça do trabalho e esperar anos por um acordo. E sempre o “empresário” ou Agente é que leva a fama de ser o vilão no Brasil, até quando isto irá perdurar não sei, sei que precisamos nos unir e mudar esta situação.

Gastos milionários e falta de planejamento financeiro estão entre os erros dos atletas que chegaram a perder todo o patrimônio acumulado ao longo da carreira.

Romário já leiloou apartamento milionário para pagar dívidas.

São Paulo – Com poucos anos de trabalho, muito dinheiro no bolso. Na trajetória de craques do futebol descobertos na adolescência, salários polpudos costumam se somar a generosos contratos de publicidade com cada vez mais frequência. Mas se a ascensão dentro e fora dos gramados é meteórica, a queda – pelo menos financeira – também pode ser.

“Via de regra esses profissionais ganham muito dinheiro em um prazo curto de tempo. A fartura pode dar a impressão que os recursos nunca vão acabar”, afirma o educador financeiro Mauro Calil. Para ele, a rápida mudança no padrão de vida facilmente pode se converter em descontrole. “Muitos esticam o salário e gastam em excesso com coisas que não tinham como carros importados, viagens caras e roupas de marca.”

Segundo Calil, qualquer aumento é motivador - mas por apenas três meses. “A partir daí você já se acostuma a fazer gastos mais altos, achando que o ideal seria que você ganhasse um pouco mais", alerta. A lição que fica é a mesma para qualquer pessoa, independente de demonstrar ou não habilidade com a bola: saber dizer não às tentadoras possibilidades de consumo, poupando no mínimo 10% salário é imprescindível para viver com conforto no futuro.

Dívida e prisão

Marcada por tumultuados episódios financeiros, a vida pessoal do ex-jogador Romário ganhou as páginas dos jornais em 2009. Na época, o baixinho perdeu sua cobertura na Barra da Tijuca, no Rio de Janeiro, e chegou a passar um dia atrás das grades. O motivo? Dívidas e não pagamento de pensão alimentícia.

Em pelo menos duas ocasiões a informalidade do craque em lidar com suas pendências lhe custou caro. Seu vizinho de baixo o processou por uma infiltração em 2003. O dano teria sido causado por obras feitas no apartamento de Romário. Inicialmente, o ex-jogador teria tentado resolver o impasse com um mal sucedido acordo verbal. Desde o início da pendenga, o processo exigiu o ressarcimento pelo reparo, além do valor que o vizinho deixou de embolsar com o aluguel do imóvel.

Com o impasse, os anos passaram e o prejuízo só cresceu. "Não tem jeito, quanto mais rápido você resolver problemas que envolvem dinheiro, menor será a dor de cabeça, já que juros e correção monetária devem aumentar significativamente o tamanho do rombo", alerta o educador financeiro Mauro Calil. No caso de Romário, a indenização estipulada em 2009 passou de 5,5 milhões de reais.

Para arcar com o pagamento, a justiça determinou que o craque leiloasse seu apartamento de 776m², vendido por 8 milhões de reais. O dinheiro foi usado para quitar outras dívidas deixadas pelo caminho, como parcelas de condomínio atrasadas e débitos com a Receita Federal.

Romário também emprestou recursos ao Vasco e até abriu mão dos seus direitos de imagem. A camaradagem, contudo, não foi reconhecida pela nova diretoria do clube, que não assumiu a dívida de 22 milhões reais feita com o craque. Como não há recibos formais de depósitos, mas apenas lançamentos no balanço do Vasco e uma confissão assinada pela antiga diretoria em 2004, o baixinho ficou a ver navios em uma querela que pode se estender por anos a fio.

Para Mauro Calil, não importa quais forem os laços de amizade ou família. Antes de emprestar dinheiro, qualquer pessoa deve se cercar de garantias. "Registre uma nota promissória ou um termo de confissão de dívida no cartório de títulos", aconselha.

A maré da sorte pode ter mudado para o baixinho depois de ele ter assumido o mandato de deputado federal. Para Müller, seu companheiro na conquista do tetracampeonato mundial de futebol, 2011 foi o ano de assumir os erros do passado. Recentemente o ex-jogador veio a público dizer que embora tenha acumulado rios de dinheiro enquanto jovem, a fortuna foi torrada em gastos "desnecessários" e "vaidades pessoais".

Morando na casa de um amigo e sem nenhum dos vários carros e imóveis que chegou a ter, o ex-jogador chegou inclusive a vender a igreja da qual foi pastor. “O erro foi a falta de planejamento financeiro”, diz Calil. “O ideal para qualquer pessoa é aplicar a regra dos 70/30. Viva com 70% da sua renda e guarde 30% dos recursos todos os meses, sendo que o comprometimento com prestações pode tomar no máximo 20% do salário.”

Embora com consequências menos drásticas, a história do ex-jogador Zé Elias também costuma se repetir com muitos outros craques. Preso por um mês por não pagar pensão alimentícia aos dois filhos, o ex-corinthiano ganhou a liberdade no fim de agosto.

A dívida foi estimada em quase 1 milhão de reais. "Pesquisando os hábitos do pai, um advogado hábil sempre poderá provar que o relógio caro, os ternos bem cortados, as grifes e os carrões são uma prova de que o jogador pode sim arcar com pensões altas", afirma Mauro Calil. "Mas a carreira pode acabar rápido e o jogador descer de 300.000 reais por mês para muito menos que isso. Se ele mantiver o mesmo nível de gastos, entretanto, este será o parâmetro para o pagamento da pensão."

Depois da experiência, Zé Elias alegou não conseguir mais dormir e chegou a sugerir que os casos como o seu poderiam receber pena alternativa. Mas infelizmente ainda temos muita coisa para mudar e mudar para melhor.
