Forthcoming Rule Changes Affecting All Licensed Players' Agents

I am surprised that the Licensed FIFA Agents on this group are not discussing the upcoming changes in the area of FIFA Agents. As professionally licensed group of individuals this is issue should be of paramount importance and an active discussion topic on this forum.

Let me introduce the issue. For a few years there has appeared to be pressure on FIFA to do away with the regulations governing players agents. The licensing requirements and the liability insurance requirements have functioned as a mechanism at the international and national level to standardize the practice of players' agents. FIFA now wants to do away with this process entirely and allow for what they have termed 'intermediaries'. All the intermediary has to do is register at the local level.

There are many reasons why this could be happening.

1) People who have wanted to become FIFA Agents have failed the exams too many times. As such these people are not able to call themselves Licensed Players' Agents.

2) Unlicensed Agents are already active in 70% of football transactions according to various sources. As such, it appears that FIFA may feel that the current structure is ineffective.

3) Third Party Transactions have become very popular (though banned in several regions) and have resulted in layers of 'ownership' of football players (mostly from South America).

Please take the time to read the new regulations here:

* http://www.fifa.com/aboutfifa/organisation/bodies/congress/news/newsid=2363136/

* http://www.fifa.com/aboutfifa/organisation/administration/news/newsid=2301236/

There could be many forces driving forces that are pushing FIFA in this direction. Let us look at a few of them.

* Agence France Press reported that at the close of this most recent transfer Europe's big five leagues generted over $3 billion in player transactions (http://news.yahoo.com/manchester-united-confirm-loan-move-radamel-falcao-003816991--sow.html). This is likely the strongest driving force.

A careful read of the regulations will show this statement: "IF THE INTERMEDIARY CONCERNED IS A LEGAL PERSON, the association responsible for registering the transaction will also have to be satisfi ed that the individuals representing the legal entity within the scope of the transaction in question have an impeccable reputation."

This could imply that the intermediary may NOT be a legal person. Does this mean that an intermediary could be:
-- An investment bank?
-- A hedge fund?
-- A sports agency?
-- A marketing agency?
-- A talent agency?
-- A portfolio manager?

GERENTE DE FUTEBOL DEVE ACABAR / FOOTBALL MANAGER WOULD END

The challenge today is to find the coach who makes all these functions, because the coach is actually a more professional field and football manager is a coach more support. For this, the coach will have to take more time inside the club just to develop this role.

The good side of this change is that the relationship with the board of football will improve because there will be no more intermediaries and communication will be direct, ie, coach and board without management of football in the middle. Still have financial gain, because the club does not need to bear the cost of this professional.

As the coach is nothing more than a manager of football area, this professional will be even better, more important. The greatest proof of this is the renovation of Vanderlei Luxembourg with Gremio / RS.

After signing the contract this week (11/22/2013), Vanderlei initiated talks with the direction the club to improve your team's squad for the year 2013. There gaucho club and he did correct himself sat with the direction the club Gaucho to set the rules for 2013. Without intermediaries. This is to manage a team, be it football, be it in any other area.

The coach must make the choice at the time of forming your team, along with the direction and nobody else.

Very relevant your comment. However, I think this function tends to be better defined, a Football Manager have to take care of the basic divisions also, its structuring and development, linked directly to the CEO, to make contracts, or at least recommend to the presidency, and is course to scout players, both, professionals and the amateurs (basic divisions, so relegated in our professional football) and can be brought to be worked on and part of the institution's assets.

Besides that, the function is distorted, a Football Manager is not a "coach", never was and never will be. Certainly someone must be very understanding of football played, but never a coach should be a person with knowledge of identifying future good players, also understand the value of contracts, this bureaucracy and the Laws which govern it, must also have knowledge international market and especially what happens in football in your own region.

We cannot admit at least in Brazilian football, a coach hiring players because he is connected to a very real action in our football, if he losing 4-5 matches is fired and how are the players he brought in? Another major issue is the ethical question, for example, the commission paid out that athletes are being forced to donate to play?

For some head coaches are not even a preoccupation a little calling with his honesty or transparency, which is worth the money in your bank account. Another thing is the planning of medium and long duration that every professional club should have, and when we have a real dance of admissions and dismissals in the career of the coach, as is all of this.

So this Football Manager role must be further revamped, with more functions and refill with the club functions in the football area, only, giving them the status of "official club", with signed and paid at payroll and taxes, also. But they have to be professionals in this business the club cannot put a friend, a counselor, or someone of his friendship to be as Football Manager, but this tends to end up as an administration committed a very professional club. And preferably that he was a player and there is a synergy and identification with the institution. Cheers buddy.

Corinthians has retained its position as Brazilian football’s leading revenue generator for the third consecutive year, but the club has deflected suggestions that its dominant position is under threat.
Auditing and consulting company BDO’s report into the financial state of Brazil’s top 20 clubs in 2011 outlines that Corinthians generated revenues of US$144.7 million, a 37% increase on the previous year. Sao Paulo came in second place with $112.7 million, while Internacional took third with $98.8 million. Santos was the biggest climber, with its revenue jumping by 62% to occupy fourth place with $94.3 million.
BDO’s report details that Corinthians’ strength is mainly owed to its television revenues, which make up 39% of its total income. Revenue generated by player transfers and the sale of economic rights to players still at the club also rose from 17% of the total to 21% year-on-year. However, BDO director, Amir Somoggi, told Globo Esporte: “We can say that Corinthians is not at its best.
There was only one major discrepancy in relation to Sao Paulo in second place because of the large share of TV (revenue) that the club has. If the question of transfer of athletes is excluded from the sum, the difference between the two clubs drops to about R$29 million (US$14.5 million) – a much smaller number.”
Corinthians’ figures saw the notable reduction of income from sponsorship and advertising. The Sao Paulo-based club’s vice-president of finance, Raul Correa da Silva, explained the drop from a 22% share to 15% stating: “The 2010 season was special for the club, being the centenary year and having Ronaldo on the field, therefore attracting a greater appeal. Moreover, in 2011, we had no involvement in the (Copa) Libertadores.
It’s just a natural reflex. We had a special year with the sale of players, but it’s not a normal situation. We have a staff of qualified professionals who seek to reap rewards on projects that last for 10 years and beyond administrations.”
