O processo contra o ex-jogador e comentarista esportivo Edmundo, de 40 anos, pelo acidente de carro em dezembro de 1995 que resultou na morte de três pessoas, foi extinto pelo ministro do Supremo Tribunal Federal (STF), Joaquim Barbosa. Na decisão, de 9 de setembro, mas publicada apenas nesta quarta-feira no Diário da Justiça Eletrônico, Barbosa declarou extinta a punibilidade devido à prescrição do crime.
O acidente ocorreu depois que o ex-jogador saiu de uma boate, na noite de 2 de dezembro de 1995. Em 1999, acusado de homicídio culposo e lesão corporal, Edmundo foi condenado a quatro anos e seis meses de prisão, em regime semi-aberto, mas respondia em liberdade.
Na decisão que extinguiu o processo, o ministro Barbosa afirmou que o prazo de prescrição para o crime era de oito anos. "Ao proceder ao exame dos autos, constato que já transcorreram oito anos entre a última causa interruptiva - qual seja a publicação da sentença condenatória recorrível - e a data de hoje", relatou.
Em junho deste ano, Edmundo foi preso em um flat no Itaim Bibi, zona oeste de São Paulo, e levado à 3ª Delegacia Seccional Oeste em Pinheiros. Ele passou mais de 12 horas em uma cela de seis metros quadrados, sem colchão e janela, mas, no fim do dia, foi beneficiado por um habeas corpus e acabou liberado.
A decisão de prender o ex-jogador, na época, partiu do juiz da Vara de Execuções Penais (VEP), do Tribunal de Justiça do Rio (TJ-RJ), Eduardo Carvalho de Figueiredo. Já a decisão de soltar Edmundo foi da desembargadora da 6ª Câmara Criminal do TJ-RJ, Rosita Maria de Oliveira, que afirmou ainda caber recurso no processo que corria contra o ex-atleta.
"O ministro reconheceu a prescrição e extinguiu a punibilidade, agora o processo acabou, finalmente. Acabou, não tem mais o que fazer, o processo vai para o arquivo", afirmou o advogado de Edmundo, Arthur Lavigne Júnior.
Infelizmente temos que falar sobre isto, se fosse alguém sem dinheiro, estaria preso e certamente arruinado. Entretanto, Edmundo está empregado, ganha muito bem, está nas paradas de sucesso (não tenho nada contra ele), nem ao menos o conheço, mais aqui estamos tratando de irresponsabilidade, falta de comprometimento, desrespeito ao ser humano e o que é pior, uma completa falta de respeito às Leis que mostram claramente não valer nada no Brasil.
Enquanto atos desta natureza forem assim tratados não teremos um País de respeito e com respeito. Precisamos parar com esta maneira de tratarmos as coisas, basta ter dinheiro e se consegue ser maior do que a Justiça, assim é nosso Brasil, assim é o nosso sistema, é uma pena.
