Uma decisão da Justiça de São Paulo deve conturbar ainda mais a polêmica em torno da Taça das Bolinhas.
Na noite de ontem, o juiz Marcelo Mesquita Saraiva, da 15ª Vara Cível da Justiça Federal em SP, julgou ação de manutenção de posse do São Paulo para que o troféu permanecesse no clube até o fim do imbróglio.
Saraiva deu razão ao time e determinou que a taça permanecesse no Morumbi até o término da polêmica, que envolve também o Flamengo e o Sport.
A decisão vai de encontro a outra tomada por um juiz do Rio de Janeiro determinando que o São Paulo devolva o troféu em 24 horas à CEF (Caixa Econômica Federal), já que ela é reivindicada também pelo Flamengo, que teve o seu título de 1987 reconhecido pela CBF e também se tornou pentacampeão, como o São Paulo.
O clube paulista, por motivos óbvios, prefere obedecer à Justiça federal de São Paulo e ficar com a taça.

Também na terça à noite, o juiz Francisco Alves, da 2ª Vara Federal, decretou que o Sport seja reconhecido pela CBF, em 48 horas, o único campeão Brasileiro de 1987.
Com isso, o Flamengo, que era considerado pela entidade o co-campeão daquele ano, passará a ter cinco títulos nacionais oficiais e não poderá reivindicar a posse do troféu de vida polêmica, já que o clube carioca alcançou o feito depois do São Paulo.
"Fiquei estarrecido. Discutir título de um campeonato de futebol na Justiça não me parece o foro mais correto. Isso tem que ser discutido internamente, na CBF", comentou o vice-jurídico flamenguista, Rafael de Piro.
A taça, concedida pela Caixa ao primeiro clube cinco vezes campeão brasileiro, está com o time do Morumbi há cerca de duas semanas. Mas havia uma liminar na Justiça que o obrigava a devolvê-la.
A discórdia está relacionada ao ano de 1987, quando a CBF deixou a organização do Brasileiro nas mãos do Clube dos 13. O Flamengo venceu o principal módulo da Copa União, mas, em comum acordo com os outros times da elite, não enfrentou os melhores do outro módulo.
Na época, o Sport foi decretado campeão brasileiro pela CBF e disputou a Libertadores. O título do Flamengo foi reconhecido pela organização do campeonato.
Amparada por uma decisão jurídica final, a qual não cabe recurso, favorável ao Sport, a Caixa entregou a taça ao São Paulo. Uma semana depois, no entanto, a CBF passou a considerar também o título da equipe do Rio.
A CBF informou que só irá comentar a decisão quando for notificada judicialmente.
