O MPF (Ministério Público Federal) em São Paulo recomendou ao prefeito Gilberto Kassab que anule a cláusula de confidencialidade que impede a divulgação integral do Acordo-Sede, documento celebrado entre a Prefeitura Municipal de São Paulo e o COL (Comitê Organizador Local) da Copa do Mundo de 2014.

Para o procurador da República José Roberto Pimenta Oliveira, a cláusula representa “graves restrições ao princípio constitucional da publicidade” e deve ser anulada por ilegalidade. O prefeito terá prazo de 10 dias, a partir do recebimento, para informar ao MPF se acata ou não a recomendação datada do dia 5 de outubro e, em caso positivo, quais as medidas adotadas. Caso a recomendação não seja acatada, o MPF poderá adotar as “medidas judiciais cabíveis”.

O documento trata dos direitos e obrigações do Município de São Paulo e do COL na realização da Copa do Mundo de 2014, e uma de suas cláusulas estabelece o termo de confidencialidade do contrato.

Oliveira faz parte do Grupo de Trabalho criado pelo MPF para acompanhar a aplicação de verbas federais na realização da Copa de 2014. No ano passado, ele começou a acompanhar os preparativos para a realização de “Fan Fests”, locais determinados onde haverá a exibição pública dos jogos. A previsão é de que milhares de torcedores acompanhem os jogos nessas “Fans”.

Nesse trabalho, o MPF requisitou uma cópia integral do Acordo-Sede e constatou que o documento não estava disponível em nenhum sítio eletrônico governamental de acesso público. “No bojo do contrato celebrado entre o Município de São Paulo e o COL não há nenhuma situação a justificar possível ressalva decorrente de 'sigilo imprescindível à segurança da sociedade e do Estado'”, ressalta o procurador.

Segundo ele, a confidencialidade impede o livre acesso ao documento por parte dos órgãos de controle da Administração Pública, em especial o Tribunal de Contas e o Ministério Público. O procurador lembrou, também, que a Lei de Acesso à Informação garante ampla divulgação de todos os contratos celebrados pelos entes públicos.

O MPF recomendou a Kassab que, além da anulação, determine a suspensão imediata dos efeitos da cláusula de confidencialidade e promova ampla divulgação do Acordo-Sede no sítio governamental da Prefeitura. E que, mediante processo administrativo, anule o item, reconhecendo que “não há sustentação jurídica para a confidencialidade ou sigilo”.

“A mesma iniciativa deve ser adotada para os demais Acordos-Sede, celebrados com os demais Municípios-Sede de jogos da Copa do Mundo de 2014”, afirmou Pimenta, que considera intolerável a confidencialidade de documentos públicos, o que dificulta o controle social da atuação da Administração Pública.

Assino embaixo, acabou o tempo em que se usava o dinheiro dos nossos impostos sem mostrar onde foi e como foi. Estamos no século XXI e os políticos precisam aprender que são funcionários do País e quem os paga somos nós, donos dos recursos, portanto, tem que dar conta deste dinheiro e mostrar onde está.

Federal Public Ministry and they Attorneys points irregularity

Natal, enfim, respirou aliviada ontem quando o governo do Rio Grande do Norte revelou que ao menos uma empresa, a OAS, apresentou proposta na licitação para a construção da Arena das Dunas, que será o palco potiguar da Copa de 2014.

Mas a sede, uma das mais atrasadas no cronograma de obras para o Mundial, ainda corre o risco de sofrer um grave percalço e ficar sem o financiamento do BNDES para as obras no estádio, orçado em R$ 400 milhões.

Em dezembro, o Ministério Público Federal (MPF) apontou irregularidades na licitação da Parceria Público-Privada (PPP) do estádio, que acabou deserta. Como o governo estadual teve que redigir um novo edital, o MPF sugeriu diversas modificações.

A Procuradoria alertava para o fato de que, no último contrato, alguns riscos financeiros e econômicos --motivados por variações cambiais ou alterações no projeto, por exemplo-- recaíam quase que exclusivamente sobre o poder público.

"Alguns dispositivos do edital favoreciam o parceiro privado", diz o procurador Rodrigo Telles de Souza, responsável por enviar as recomendações ao governo.

Para o MPF, os eventuais riscos financeiros da PPP devem ser assumidos em boa parte pelo parceiro privado.

Segundo o procurador, o governo não acatou as recomendações. Diante da falta de ajustes no novo edital, Telles de Souza recomendou ao BNDES que não aprove financiamentos para a Arena das Dunas até que as irregularidades constatadas no contrato sejam alteradas.

"O governo não cumpriu as sugestões. Eles estão assumindo um risco. Isso ameaça a participação do Rio Grande do Norte na Copa porque o BNDES pode não repassar a verba", afirmou o procurador, que acredita que o banco acatará a sua recomendação.

"Em outras sedes da Copa que tiveram problemas com a licitação do estádio, o bancou acatou a sugestão do Ministério Público" ressaltou.

O procurador também enviou ao Tribunal de Contas da União a argumentação usada pelo governo potiguar para não cumprir as recomendações e aguarda um posicionamento da entidade.

Consultado pela reportagem, Demétrio Torres, secretário extraordinário para a Copa em Natal, limitou-se a dizer que o novo edital atende às adequações exigidas pelo Ministério Público. O secretário manteve a posição mesmo quando foi informado de que a Procuradoria afirmava o contrário.

Infelizmente isto vai ser manchete até o final da obras para esta Copa do Mundo. Aqui em Natal, em Recife, em Brasília, ou seja, onde tiver alguma obra no Brasil, teremos desvios de dinheiro, preços super faturados e outros esquemas que estão manchando nosso País.

"In other constructions for the World Cup in 2014 venues that had problems with the bidding stage, the bank accepted the suggestion of the prosecutor" he said.

The prosecutor also sent to the Court of Audit, the arguments used by the government for Natal not comply with the recommendations and is awaiting a position of authority.
