FIFA COBRA CBF POR TORCEDORES DE FLAMENGO E PORTUGUESA IREM À JUSTIÇA COMUM

Nesta sexta-feira, um dia após derrubar todas as liminares pró-Portuguesa e divulgar a tabela do Campeonato Brasileiro deste ano, a CBF revelou em seu site oficial um fax enviado pela FIFA cobrando explicações quanto às ações na Justiça Comum do time paulista e do Flamengo.

A Lusa perdeu quatro pontos na tabela do último nacional por ter escalado de forma irregular o meia Héverton, o que a rebaixou para a segunda divisão e livrou o Fluminense da queda. O clube rubro-negro também teve retirado à mesma pontuação por ter colocado André Santos para jogar mesmo suspenso.

Torcedores dos dois times foram à Justiça Comum com liminares para revogar a decisão do Superior Tribunal de Justiça Desportiva (STJD), algo que a FIFA condena em seu regulamento. O Flamengo já entrou com recurso na Corte Arbitral do Esporte (CAS), última instância esportiva.

"Considerado que é sua obrigação (da CBF) proibir o recurso a cortes ordinárias da lei em matéria de esportes no Brasil, nós pedimos a você para tomar as medidas necessárias que você julgue apropriada para colocar um fim nos procedimentos atuais envolvendo Flamengo e Portuguesa", diz a entidade máxima do futebol mundial no fax endereçado ao secretário-geral da CBF, Julio Cesar Avelleda.

Em fax enviado em 5 de fevereiro ao secretário-geral Julio Cesar Avelleda, a FIFA chama a atenção da CBF para a observância do art. 68, parágrafo 2º do seu Estatuto, que estabelece o seguinte: "recurso para tribunais ordinários (Justiça comum) é proibido, a menos que esteja previsto na regulamentação da FIFA".

Também para o parágrafo 3 do art. 68, ao ressaltar que associações-membros (como é o caso da CBF) devem assegurar que "esta provisão seja rigorosamente implementada dentro da respectiva associação e que na falha do cumprimento dessa obrigação, por qualquer parte, sanções devem ser impostas pela associação à parte infratora".

A FIFA ratifica que é dever da CBF proibir o recurso para tribunais ordinários relacionados à matéria desportiva no Brasil e solicita que e entidade brasileira tome as medidas necessárias para pôr fim ao atual procedimento envolvendo os clubes Flamengo e Portuguesa de Desportos, evitando ainda que esse tipo de procedimento aconteça novamente no futuro.

O presidente do Santos garantiu ter pedido a não convocação de Neymar para a recente excursão da seleção brasileira e acusou o diretor de seleções da CBF e ex-presidente do clube rival, Andrés Sanchez, de ser mentiroso.

O mandatário alvinegro culpa o chamado de Mano Menezes pelo cansaço claramente demonstrado pelo atacante santista no primeiro jogo da semifinal, na quarta-feira passada. Ele chegou a dizer que existem dois pesos e duas medidas em relação aos dois clubes, sugerindo favorecimento ao Corinthians.

"Pedir desculpas por quê? Ele [Andrés] mentiu, disse que eu não tinha pedido a não convocação do Neymar, o que é uma mentira deslavada. Eu liguei para ele quando da convocação e disse que se as quatro partidas eram amistosas, não tinha motivo para levar o Neymar", afirmou Luis Álvaro entrevista exclusiva à Rádio Estadão ESPN. 

"Ele consultou o nome e disse não porque era preparação para a Olimpíada e tinha que testar o time. Testar o Rafael [goleiro] ou o Ganso eu até entendo, mas testar o Neymar não tem o menor sentido", seguiu o presidente santista. Andrés afirmara a imprensa que se Luis Álvaro queria a não convocação de Neymar era só ter pedido.

Luis Álvaro ainda lembrou o imbróglio recente envolvendo a convocação do são-paulino Lucas. "O Andrés negou a liberação do Lucas, e Juvenal foi ao [presidente da CBF, José Maria] Marin, eu não quis fazer isso. Deixei para lá. Mas tenho um relatório médico de que o menino [Neymar] voltou esbagaçado dessa excursão da seleção, afetado emocionalmente e fisicamente, eu fico efetivamente revoltado", acrescentou.

É uma tristeza tomar conhecimento destas atitudes e isto mostra claramente que estamos sendo administrados por pessoas que não se importam com o futebol profissional brasileiro e que de futebol profissional não entendem uma vírgula. Vejam que até hoje, não temos nada resolvido em relação a terceira e quarta divisões, pois o presidente da CBF estava simplesmente passeando pelos Estados Unidos, enquanto o nosso futebol agonizava, aliás, continua na UTI e respirando por aparelhos.

Basta cumprir o estatuto da FIFA e o futebol volta aos seus trilhos, mesmo que adernando, sem rumo e sem comandante.

Depois de um dia tenso, com reuniões, ameaças e julgamento de liminares, a direção da Confederação Brasileira de Futebol (CBF) parece ter encontrado uma luz no fim do túnel para iniciar o Campeonato Brasileiro das Séries C e D - equivalentes às terceira e quarta divisões. A entidade obteve vitórias contra decisões da Justiça Comum nos Estados do Acre, Tocantins e do Rio Grande do Sul e no início da noite confirmou a exclusão do Brasil, de Pelotas (RS), da Série C. Com isso, a largada destas competições pode acontecer no outro final de semana - dias 23 e 24 de junho.

No início da tarde, o presidente da CBF, José Maria Marin, se reuniu com os representantes dos quatro clubes que entraram na Justiça Comum reclamando por seus supostos direitos: Brasil-RS, Rio Branco-AC, Treze-PB e Araguaína-TO. O encontro durou mais de duas horas na sede do Superior Tribunal de Justiça Desportiva (STJD), no Rio de Janeiro.

Marin pediu aos dirigentes dos clubes que retirassem as ações, mas não foi atendido. 

Depois os ameaçou e deu prazo até a próxima segunda para que os clubes cumprissem a orientação, sob pena deles sofreram sanções da FIFA, que coíbe ações na Justiça Comum. A pena, mais rigorosa, seria a exclusão deles de todas as competições oficiais.

À tarde, a CBF conseguiu vitórias importantes nos tribunais. O Superior Tribunal de Justiça (STJ) de Brasília derrubou as liminares da Justiça do Acre e de Tocantins, que favoreciam, respectivamente, a Rio Branco e Araguaína. E a vitória mais comemorada aconteceu no final da tarde, em Porto Alegre. A 12.ª Câmara do Tribunal de Justiça do Rio Grande do Sul - TJ-RS - derrubou a liminar que incluía o Brasil na Série C. À noite, o site oficial da CBF se apressou em divulgar a conquista jurídica confirmando a exclusão do clube de Pelotas de nome Brasil da Série C e devolvendo a vaga para o Santo André-SP.

Além disso, a CBF confirmou a decisão do Superior Tribunal de Justiça Desportiva (STJD), que puniu o time gaúcho com a perda de seis pontos, em virtude da "inclusão em seu time de um jogador sem condição legal, visto que deixou de cumprir a suspensão automática resultante de expulsão na última partida da Série C do ano de 2010".

De acordo com a entidade máxima do futebol nacional, a decisão da justiça gaúcha fortalece a confiança da CBF na obtenção de um resultado final, reconhecendo a competência do STJD em apreciar e julgar a matéria. Agora resta saber qual time vai ficar com a última vaga da Série C: o Rio Branco, que fez um acordo ano passado com a CBF, ou o Treze, que sonha com a mesma vaga.

Pois é “acordos” levam a isto, a falta de cumprir o que manda a FIFA, afinal de contas isto é uma entidade privada e só entra no futebol profissional quem aceita as regras. Agora, como havia um presidente que não tinha legitimidade para ser o que era, vivia fazendo “conchavos” e que fatalmente levam a desmoralização da entidade máxima no Brasil e consequentemente da mentora maior na Suíça.

E como comentei em notas passadas aqui mesmo; se o atual presidente da Confederação Brasileira de Futebol estivesse onde deveria “estava nos Estados Unidos”, só podia está treinando o time do Mano Menezes. Se cá estivesse, as coisas já estariam resolvidas, não teríamos tantos prejuízos além da quase completa desmoralização do futebol brasileiro, que ao invés de ter somente 4 divisões profissionais deveria ter no mínimo o dobro para poder comportar todos os que gostam e fazem o futebol no Brasil.

Não é justo e muito menos correto, nosso País ter menos divisões profissionais que a Alemanha, Portugal e tantos outros Países que tem o tamanho de um ou dois estados brasileiros. Precisamos olhar as coisas profissionalmente e dar chance a todos os brasileiros e não somente a um trecho ou eixo do Brasil o futebol é como uma indústria dá empregos, fomenta desenvolvimento e é lucrativo quando feito com conhecimento.

By early afternoon, the president of the CBF, Jose Maria Marin, met with representatives of the four clubs who entered in the Common Justice complaining about their supposed rights: RS-Brazil of Pelotas, Rio Branco-AC,  Thirteen from Campina Grande-PB and-Araguaína from TO State. The meeting lasted over two hours at the headquarters of the Superior Court of Sports Justice (STJD), in Rio de Janeiro.

Marin called to the club to withdraw the action, but was not granted. After threatened them and set a deadline until next Monday so that clubs comply with the guidance, under penalty of them suffered FIFA sanctions that prohibits actions on Justice Policy. The penalty, more stringent, it would be the exclusion of them from all official competitions.

In the afternoon, CBF achieved important victories in the courts. The Superior Court of Justice (STJ) Brasilia overturned the injunctions of Justice of Acre and Tocantins, favoring, respectively, the Rio Branco and Araguaina.  And the most celebrated victory came in the late afternoon, in Porto Alegre. A 12. Th Chamber of the Court of Rio Grande do Sul - RS-TJ - overturned the injunction that included Brazil of Pelotas in Series C.

A SITUAÇÃO DO FUTEBOL PROFISSIONAL BRASILEIRO / THE SITUATION OF THE BRAZILIAN PROFESSIONAL FOOTBALL.

Estamos assistindo nos clubes uma verdadeira odisseia de situações criadas pelo antigo presidente da CBF que ao invés de fazer se cumprir o regulamento da FIFA, fazia o que estava acostumado a fazer, que era “arrumadinhos”, politicagens para ficar bem na fita e parecer o pai do esporte no Brasil. E agora o futebol Brasileiro esta perto de parar por suas falcatruas e fico me perguntando até quando este atual irá manter em segredo os desmandos e os desvios.

Já sabemos que uma empresa “comprou” os direitos de mandar os jogos da Seleção Nacional a perder de vista, ninguém sabe os valores e a data para mais esta situação ser corrigida, começo a pensar que não mudará nunca e como o atual presidente da CBF não tem cacife para se bancar no cargo, está caladinho, pianinho com a situação. E para completar, temos a situação de clubes entrando na Justiça Comum, sem primeiro esgotar o assunto na Justiça Desportiva que é quem de Direito para ser usada.

Vemos então os descalabros continuarem e a CBF fica jogando de um lado para o outro uma situação fácil, correta e simples de se decidir, está no estatuto da FIFA o que deve ou deveria ter sido feito, pois todos quando se filiam sabem ou deveriam saber destas regras, portanto, se tiver decência, e esta é uma palavra difícil de ser usada pela direção da CBF que poderia muito bem, extirpar estes clubes que estão tentando bagunçar o que já está bagunçado, infelizmente, e que muitos teimam em chamar nosso pobre futebol brasileiro de "profissional".

O próprio presidente da entidade, ao invés de está aqui, resolvendo os pepinos, estava nos Estados Unidos, ao redor da Seleção para aparecer nos holofotes da fama e da luxúria, pois tudo é pago pelo futebol brasileiro, e fica gozando das benesses promovidas pelo futebol. É uma pena que ninguém toma a atitude correta que seria acabar com esta improbidade administrativa imoral e desonesta.

Quem está sofrendo em primeira linha são os clubes que mesmo comandados por presidentes amadores e estagiários, tem que continuar pagando salários, contratando e assim aumentando seus problemas por conta de uma instituição que só pensa em se arrumar ou arrumar seu cofre. Pois lá o dinheiro sobra, tem até avião para seus dirigentes passearem e ninguém diz ou faz nada. É igualzinho à FIFA, lá o negócio é este, “faça o que digo, mas não faça o que faço”.
