Multadas em R$ 1 milhão por desrespeito, FIFA e Match Serviços, em Recife / Fined in R$ 1 million for contempt of CDC (Consumer Protection Code) in Recife, FIFA and Match Events Services LTD

Multadas em R$ 1 milhão por desrespeito ao CDC (Código de Defesa do Consumidor) no Recife, FIFA e a empresa Match Serviços de Eventos Ltda. recorreram à Justiça, mas não conseguiram escapar da multa de R$ 500 mil para cada. As entidades foram punidas por problemas na venda de ingressos na Arena Pernambuco durante a Copa das Confederações do ano passado.

O PROCON-PE compilou queixas de torcedores que compraram ingressos para assistir aos jogos na Arena e perceberam que seus assentos não correspondiam aos que estavam impressos nos bilhetes. Outras queixas relatavam que torcedores compraram entradas para as áreas mais próximas do campo, mas foram realocados para outros locais do estádio pelas organizadoras do evento.

Em sua defesa, FIFA e Match disseram ter agido de acordo com a Lei da Copa. Para as empresas, o PROCON-PE aplicou uma multa alta, sem qualquer fundamento. Por isso, pediram a suspensão da punição financeira até o julgamento final do mandado de segurança na 2ª Vara da Fazenda Pública do Recife. O desembargador José Ivo de Paula Guimarães, da 1ª Câmara de Direito Público de Pernambuco, contudo, negou o pedido.

"O PROCON-PE fundamentou sua decisão de acordo com a legislação vigente e aplicável ao evento, qual seja a Lei 12.663/12 (Lei da Copa), a Lei 8.078/90 (Código de Defesa do Consumidor) e o Estatuto do Torcedor (Lei 10.671/03), fazendo uma interpretação favorável ao consumidor em razão da sua vulnerabilidade frente às recorrentes", escreveu o relator.

O desembargador também declarou que as empresas tiveram o direito de se defender no processo administrativo: "Vê-se que o procedimento obedeceu aos ditames legais previstos na Lei da Copa, no Estatuto do Torcedor e no CDC, observando o contraditório e a ampla defesa exigidos, tendo havido oferecimento de defesa em tempo hábil".

Para o magistrado, o que houve, de fato, foi a interpretação e a adequação da legislação vigente em favor do consumidor, quando a Lei da Copa foi omissa. "Assim, por ter entendido que as agravantes descumpriram alguns preceitos legais, aplicou a multa aqui rebatida", descreveu, na decisão.

Bem, é difícil de acreditar, mas, estamos vendo alguma coisa acontecer em defesa de nós pobres Brasileiros, que o único direito que temos é, ficar calado e aceitar o desrespeito. Esperemos que este dinheiro seja distribuído entre aqueles prejudicados, assim teremos uma justiça completa.

The companys were being punished for problems in ticket sales in the Pernambuco Arena during the Confederations Cup last year. 

The PROCON-PE compiled complaints from fans who bought tickets to watch the games in the Arena and realized that their seats did not correspond to those that were printed on the tickets. Other complaints reported that fans bought tickets to the nearby areas of the field, but were relocated to other parts of the stadium by the event organizers. 

In his defense, FIFA and Match Events said they acted in accordance with the World Cup Law. For businesses, the PROCON-PE imposed a heavy fine, without any foundation. Therefore, they requested the suspension of financial punishment until the final judgment of injunction in the 2nd Court of Exchequer of Recife. The judge José Ivo de Paula Guimarães, 1st Public Law Chamber of Pernambuco, however, denied the request. 

"The PROCON-PE based its decision in accordance with current legislation and applicable to the event, which is the Law 12.663/12 (World Cup Law), and also Law 8.078/90 (Consumer Protection Code) and the Fan Statute (Law 10.671/03), making an interpretation favorable to the consumer because of their vulnerability to recurrent " wrote the reporter. 

The judge also ruled that the companies had the right and time

to defend itself in the administrative process: "It is seen that the procedure followed the legal doctrine laid down in the Law Cup, the Statute of the Fan and the CDC, noting the contradictory and required extensive defense has been offering defense in a timely manner. "

Well, it's hard to believe, but we are seeing something happen in defense of us poor Brazilians, the only right we have is to remain silent and accept the charges and insults. Hopefully this money is distributed among those harmed, then we will have a full justice.

A SITUAÇÃO DO FUTEBOL PROFISSIONAL BRASILEIRO / THE SITUATION OF THE BRAZILIAN PROFESSIONAL FOOTBALL.

Estamos assistindo nos clubes uma verdadeira odisseia de situações criadas pelo antigo presidente da CBF que ao invés de fazer se cumprir o regulamento da FIFA, fazia o que estava acostumado a fazer, que era “arrumadinhos”, politicagens para ficar bem na fita e parecer o pai do esporte no Brasil. E agora o futebol Brasileiro esta perto de parar por suas falcatruas e fico me perguntando até quando este atual irá manter em segredo os desmandos e os desvios.

Já sabemos que uma empresa “comprou” os direitos de mandar os jogos da Seleção Nacional a perder de vista, ninguém sabe os valores e a data para mais esta situação ser corrigida, começo a pensar que não mudará nunca e como o atual presidente da CBF não tem cacife para se bancar no cargo, está caladinho, pianinho com a situação. E para completar, temos a situação de clubes entrando na Justiça Comum, sem primeiro esgotar o assunto na Justiça Desportiva que é quem de Direito para ser usada.

Vemos então os descalabros continuarem e a CBF fica jogando de um lado para o outro uma situação fácil, correta e simples de se decidir, está no estatuto da FIFA o que deve ou deveria ter sido feito, pois todos quando se filiam sabem ou deveriam saber destas regras, portanto, se tiver decência, e esta é uma palavra difícil de ser usada pela direção da CBF que poderia muito bem, extirpar estes clubes que estão tentando bagunçar o que já está bagunçado, infelizmente, e que muitos teimam em chamar nosso pobre futebol brasileiro de "profissional".

O próprio presidente da entidade, ao invés de está aqui, resolvendo os pepinos, estava nos Estados Unidos, ao redor da Seleção para aparecer nos holofotes da fama e da luxúria, pois tudo é pago pelo futebol brasileiro, e fica gozando das benesses promovidas pelo futebol. É uma pena que ninguém toma a atitude correta que seria acabar com esta improbidade administrativa imoral e desonesta.

Quem está sofrendo em primeira linha são os clubes que mesmo comandados por presidentes amadores e estagiários, tem que continuar pagando salários, contratando e assim aumentando seus problemas por conta de uma instituição que só pensa em se arrumar ou arrumar seu cofre. Pois lá o dinheiro sobra, tem até avião para seus dirigentes passearem e ninguém diz ou faz nada. É igualzinho à FIFA, lá o negócio é este, “faça o que digo, mas não faça o que faço”.
