LIMINAR SUSPENDE PATROCINIO DA CAIXA AO CORINTHIANS / JUSTIÇA STOP SPONSORSHIP FROM THE FEDERAL BANK”CAIXA” TO CORINTHIANS

Ação popular foi ajuizada no Rio Grande do Sul e rende multa de 150 mil reais por dia. Clube e banco negam terem sido informados.

O pagamento do patrocinio da Caixa Econômica Federal ao Corinthians está suspenso, de acordo com uma liminar concedida Justiça do Rio Grande do Sul.

A determinação partiu do juiz Altair Antonio de Gregório, da 6ª Vara do Tribunal Regional Federal-RS. O pedido foi feito em uma ação popular ajuizada pelo advogado gaúcho Antônio Beiriz.

Segundo o despacho, a justificativa para abrir o processo é que um banco público deveria gastar dinheiro em publicidade apenas com caráter educativo e informativo. 

O juiz aceitou o argumento e acrescentou que, "por ter um dos maiores orçamentos do futebol brasileiro, o Corinthians não deve ser beneficiado pelo apoio". Ele citou ainda outros clubes patrocinados pelo banco, o Avaí e o Figueirense, e diz que o apoio se justifica nesses casos, pois "mantém o equilíbrio local" e apoiar dois times do mesmo Estado.

O Corinthians e a Caixa informaram em comunicados que ainda não foram informados da decisão. O acordo foi assinado no fim do ano passado, pouco antes da participação do time no Mundial de Clubes, e rende R$ 30 milhões por ano. 

“A Caixa Econômica Federal reitera a legalidade do contrato de patrocínio ao Corinthians e informa que não foi intimada da decisão. Assim que tomar conhecimento da liminar, analisará seus termos e providenciará o recurso”, afirmou o banco em nota.

A multa prevista para o caso de descumprimento da decisão é de R$ 150 mil por dia.

Realmente, dá uma tristeza muito grande em ver este tipo de determinação feita por um Juiz, mostra bem o tipo de Justiça que temos e para onde iremos se continuarmos tratando as coisas desta maneira. No caso dos dois clubes de seu estado, está tudo bem, e no caso do Corinthians, está errado.

Concordo inteiramente em que o patrocínio está imoral, mas se está ilegal, deveria está para todos e não somente para os poucos clubes que a CAIXA patrocina que tem esta regalia. E no caso deste magistrado, falta certamente alguém com melhor conhecimento e até discernimento do que é certo e o que errado, além de alguém que não tenha este bairrismo.

Acredito que a CAIXA deveria sim, patrocinar o campeonato como um todo, pois se trata de um banco nacional e o mais agravante, um órgão federal que nos pertence, ou seja, do País, então assim teríamos realmente uma ação de marketing bem centrada e com bom senso e seria feita justiça para todos os estados brasileiros e porque não dizer também, para todos os brasileiros que usam este serviço e guardam seu dinheirinho neste banco.   

Usar este argumento de que o Corinthians não pode nem deve receber, porque já recebe muito dinheiro é uma piada de muito mau gosto e de uma falta incrível de integridade deste senhor que representa nossa justiça.

I fully agree that the sponsorship is immoral, but if you're illegal, should is for all clubs and not just for the few clubs that get sponsor by the CAIXA and that has this privilege. And this magistrate opinion, is completely wrong, certainly are lacking of knowledge and we need someone with better knowledge and insight to what is right and wrong, and someone who does not have this parochialism.

I believe that the CAIXA would rather sponsor the tournament as a whole, because it is a national bank and the most aggravating, a federal agency that belongs to us, ie to the country, then we would really like a marketing focused and well common sense and justice would be done for all Brazilian states and also why not say, for all Brazilians clubs because who use this service and keep your buck with this bank come from all states.

Using this argument that the Corinthians, cannot and should receive, because it already receives too much money is a joke in very bad taste and an incredible lack of integrity of this man who is our righteousness. This is my opinion.

No fim do ano passado, Victor Andrade assinou o seu primeiro contrato como profissional. No acordo, válido até 2014, os santistas estipularam a multa rescisória do atacante em 50 milhões de euros.

Apontado como a nova promessa oriunda das categorias de base do Santos, o atacante Victor Andrade terá a oportunidade de subir ao elenco profissional do clube. O jogador, de apenas 16 anos, voltou nesta segunda-feira ao Brasil, depois de ser campeão com a seleção brasileira sub-20 do Torneio Oito Nações, na África do Sul, e deve ser integrado ao grupo principal do time nesta terça.

Uma reunião entre a diretoria santista e representantes de Victor está marcada para a manhã desta terça-feira, onde deve ser traçado o cronograma do atleta na equipe profissional. O jovem atacante tem chances de ser relacionado para o jogo contra o Fluminense, nesta quarta, às 21h50 (horário de Brasília), na Vila Belmiro, pela terceira rodada do Campeonato Brasileiro.

Victor Andrade chegou ao clube em meados de 2007, após o clube ter disputado a sua contratação com Benfica e Sporting, ambos de Portugal. Nada mais correto que se dar a este jovem, condições de treinar, e estudar, além de ter uma ajuda de custo para que possa ajudar sua família (que normalmente é carente). Isto teria que ser compatível com a realidade brasileira, mas é impossível se conseguir isto.

Os clubes europeus estão ávidos por descobrir talentos brasileiros ou até sul americano, como o Messi, por exemplo, se foi da Argentina quando ainda era criança e quase perdia sua identificação como cidadão Argentino. Pois na realidade o que a FIFA tem como regulamento não é cumprido aqui na América do Sul, que é a não transferência do menor, mesmo que o clube estrangeiro dê aos Pais emprego ou arranje condições financeiras para que eles acompanhem seu filho.

E às vezes se cumpre estas regras na Europa, entre eles mesmos, ou seja, aqueles clubes que tem gerência profissional e conhecimento do que pode e deve fazer para afastar este aliciamento ilegal. Os clubes são obrigados a devolverem os garotos e sofrem penalidades duras e pagamentos de pesadas multas.

Aqui, estamos longe disto, a CBF nunca regulou a atividade do Agente Credenciado junto as Federações, aos clubes e aos jogadores e principalmente aos Pais e meninos que querem ser profissionais, das normas internacionais que deveriam reger o futebol no todo e praticamente não se incomoda com isto. Sendo assim o futebol brasileiro sofre deste assédio irregular e imoral e inflaciona seus clubes quando tenta segurar estas pequenas joias em seus centros de treinamento com salários compatíveis a profissionais e incompatíveis com sua situação.
