Rússia detona ação dos EUA na FIFA: 'Parem de fazer justiça além das fronteiras'

A Rússia não gostou nem um pouco da ação da polícia norte-americana, que prendeu dirigentes da FIFA acusados de corrupção. Nesta quarta-feira (27), o Ministério de Relações Exteriores russo atacou a atitude dos Estados Unidos e definiu como "ilegal".

Em um comunicado, o ministério afirmou que se trata de "outro caso ilegal e extraterritorial da lei norte-americana". Além disso, pede que os EUA "parem de tentar fazer justiça além de suas fronteiras".

"Sem entrar em detalhes sobre as acusações ... este é claramente um caso de uso extraterritorial ilegal de lei norte-americana", aponta o comunicado no site do Ministério das Relações Exteriores russo.

"Esperamos que isso não irá de forma alguma ser utilizado para lançar uma sombra sobre a organização internacional do futebol como um todo e as suas decisões. Mais uma vez vamos pedir a Washington para parar tentativas de fazer justiça muito além de suas fronteiras usando suas normas legais. E para seguir os procedimentos legais internacionais", aumentou.

Entenda o caso

A dois dias da eleição para a presidência, um terremoto sacode a FIFA. Na madrugada desta quarta-feira, horário brasileiro, uma operação especial das autoridades suíças, sob liderança do FBI, prendeu sete executivos importantes da entidade sob a acusação de corrupção, entre eles José Maria Marin, ex-presidente da CBF. O grupo dos detidos será extraditado para os Estados Unidos a fim de uma maior investigação sobre o assunto na federação mais importante do futebol mundial.

Segundo nota oficial do Departamento de Justiça norte-americano, 14 réus são acusados de extorsão, fraude e conspiração para lavagem de dinheiro, entre outros delitos, em um "esquema de 24 anos para enriquecer através da corrupção no futebol". Sete deles foram presos na Suíça. Além de Marin, Jeffrey Webb, Eduardo Li, Julio Rocha, Costas Takkas, Eugenio Figueredo e Rafael Esquivel. Um mandado de busca também será executado na sede da Concacaf, em Miami, nos EUA.

O brasileiro J.Hawilla, dono da Traffic, conhecida empresa de marketing esportivo, é um dos réus que se declararam culpados, assim como duas empresas de seu grupo, a Traffic Sports International Inc. and Traffic Sports USA Inc. Em dezembro de 2014, segundo a justiça dos EUA, ele concordou em pagar mais de 151 milhões de dólares, sendo que US$ 25 mi foram pagos na ocasião. As acusações são de extorsão, fraude eletrônica, lavagem de dinheiro e obstrução de justiça.

Além de Hawilla, também se declararam culpados o norte-americano Charles Blazer, ex-secretário-geral da Concacaf e ex-representante dos EUA no Comitê Executivo da FIFA; Daryan e Daryll Warner, filhos do ex-presidente da FIFA Jack Warner.

Hummmmmmm, tem coisa nisto, e mesmo todos sabendo que hoje (o globo terrestre) é um mundo globalizado, uma única TERRA, ainda pensam que se pode permanecer nos séculos passados, onde, matar, roubar, saquear Países, escravizar era livre e quem tivesse mais poder/dinheiro, podia fazer tudo isso. Ledo engano amigos, hoje se dar um espirro na China e adoecemos aqui da gripe suína, uma vaca morre na Gran Bretanha e ficamos aqui de sobreaviso.

Ora, se eles (Russia), não gostam disso, não tem também o Direito de interpelar os Estado Unidos, pois, estarão incorrendo no mesmo erro (ou será que a justiça só é legal para eles?). E provavelmente teremos noticias sobre os escândalos na própria Rússia e no Catar, sobre estas próximas Copas, quem viver verá. 

Tenho certeza de que logo, logo, teremos isso revelados e a truculência ou imposição desta Nação que deve se parar o combate e a corrupção no mundo. Vá em frente US.

Pieth disse que a intervenção é necessária porque "você tem mais de 60 organizações e basicamente você está permitindo-lhes fazer o que quiserem."

A UEFA no mês passado, disse que seus membros se opuseram a uma proposta do comitê comandado pelo Pieth de que todos os membros selecionados para o Comitê Executivo da FIFA devem ser votados pelos membros da organização 209-nação inteira, e com antecedentes checados por um organismo independente.  E ainda a própria UEFA disse que seus membros devem decidir quem os representa a nível mundial e que "se as verificações de integridade são necessárias", eles devem ser manuseados por confederações. "O que estamos vendo aqui é a resistência a algumas das mais duras exigências", disse Pieth. Quanto à posição da UEFA, acrescentou: "Estou um pouco surpreso. Eles sabem que os problemas do passado existem. Eu não tenho muita confiança em verificações de integridade regionais e eu não gosto do uso da palavra "se" nessa declaração."

A reunião de Janeiro viu a UEFA declarar com seus 53 membros aprovando por unanimidade a sua oposição às reformas da FIFA e também rejeitou a demanda do Comitê de Governança Independente de que membros do conselho da FIFA tem prazo com limites definidos. No entanto, disse que as discussões do Prof. Pieth e que havia realizado com os países membros não refletem essa postura. FIFA’s anti-corruption adviser Mark Pieth has stated the Swiss government may be required to intervene amid concerns European members may seek to block reform measures for world football’s governing body.

UEFA last month said its members opposed a proposal by Pieth’s committee that any members selected to FIFA’s Executive Committee be voted upon by the organisation’s entire 209-nation membership, with background checks carried out by an independent body. UEFA said its members should decide who represents them on a world level and that “if integrity checks are required,” they should be handled by confederations. “What we are seeing here is resistance to some of the toughest requirements,” said Pieth. Regarding UEFA’s position, he added: “I’m a bit astonished. They know what the problems of the past are. I don’t have a lot of trust in regional integrity checks and I don’t like the use of the word ‘if’ in that declaration.”

The January meeting saw UEFA declare its 53 members unanimously approved its opposition to FIFA reforms and also rejected the Independent Governance Committee’s demand that FIFA board members have set-term limits. However, Pieth said discussions he had held with member nations did not reflect this stance. “All sorts of people I’ve been asking who were responsible have come back and said ‘Well no, we didn’t agree to all this,’” he said. E as consequências na Justiça brasileira podem acabar por jogar um contra o outro, porque aquilo que o “Jornal Nacional”, generosa, e equivocadamente, chamou de “comissões”, é propina mesmo, fortunas recebidas indevida e ilegalmente segundo a Justiça suíça.

Apesar de continuamente bajulado por cartolas como Carlos Nuzman, presidente do COB e, pior, do Comitê Organizador do Rio 2016, tudo indica que o fim da carreira do chefão será ainda mais vergonhoso, assim como do esperto ex-genro, condenado a ficar em Boca Raton.

A Swiss prosecutor is alleging that former FIFA president Joao Havelange and senior executive committee member Ricardo Teixeira made a boatload of cash by accepting bribes by the company that held the TV rights to the 2002 and 2006 World Cup. 

The Guardian's David Conn passed along this information gathered from a court order, which the prosecutor published in the Swiss canton of Zug, documenting a settlement from prosecutions against the accused pair made in 2010. 

Havelange and Teixeira faced embezzlement charges, but that matter became moot when they paid a settlement.  

Conn reports that the pair was found to have received the bribes from the marketing company ISL, and adds that in 1997, Havelange gave ISL exclusive marketing rights to FIFA. Also, that in 1998 that ISL was awarded the exclusive TV and radio rights to the 2002 and 2006 World Cup. 

To get these rights, ISL paid FIFA 200 million Swiss francs for the marketing and 1.4 billion for the TV rights.

Conn goes on to state that Havelange and Teixeira were given 41 million Swiss francs over eight years as a "side payment" for this. 

That is not the whole story about the alleged bribes ISL were making either. Conn states ISL made payments of 37 million Swiss francs via a separate company to "individuals and decision makers of global sports." And none of these is the most damning thing of all.

The finding that FIFA had knowledge of the bribery payments to persons within its organs is not questioned. This is firstly because various members of the executive committee had received money, and furthermore … a $1m Swiss francs] payment made to João Havelange was mistakenly directly transferred to a FIFA account.

That is the real problem and everlasting stain of these bribes. They can't be pinned on just a couple of individuals. This was a failure of the entire governing body. Credibility will not recover quickly from those kinds of allegations.

Em 2006, ele ofereceu denúncia contra o dirigente.

Na ocasião, Freire tomou como base o relatório da CPI do Futebol instalada no Congresso Nacional no início dos anos 2000. O procurador ofereceu denúncia contra Teixeira por operações de câmbio com falsa informação, o que teria gerado evasão de divisas do país.

Segundo reportagem publicada na edição desta quarta-feira do diário LANCE! A CBF teria tomado empréstimos considerados fora do padrão habitual, no Delta National Bank. As taxas de juros cobradas foram classificadas por Marcelo Freire como discrepantes das praticadas no mercado internacional.

Na época, Marcelo Freire requisitou a quebra do sigilo bancário do presidente da CBF, mas Ricardo Teixeira não foi condenado. A expectativa dentro do Ministério Público Federal do Rio (MPF-RJ), diz o LANCE! É que o procurador dê um encaminhamento ao caso até o início da próxima semana.

Se as investigações forem levadas adiante, documentos que comprovariam a participação de Teixeira poderiam ser solicitados à Justiça da Suíça, continua o jornal. O conteúdo integral desses documentos jamais foi revelado.

O amistoso entre Brasil e Portugal continua rendendo. O Ministério Público do Distrito Federal solicitou a devolução de R$ 9 milhões pagos pelo governo do DF para a Ailanto.

O controverso amistoso da seleção brasileira com Portugal, no dia 19 de novembro de 2008, alvo de investigações e denúncias envolvendo sua organização, tem em sua origem uma empresa da qual o presidente da Confederação Brasileira de Futebol (CBF) e do Comitê Organizador Local (COL) da Copa do Mundo de 2014, Ricardo Teixeira, seria mais do que um padrinho forte. O cartola seria uma espécie de "sócio oculto" da Brasil 100% Marketing, parceira da CBF em diversas ocasiões, segundo diz à Revista ESPN Nathalie Peackock, ex-mulher de um dos sócios da agência, o economista Cláudio Honigman.

Em reportagem assinada pelo comentarista dos canais ESPN e blogueiro do ESPN.com.br Lúcio de Castro na edição de setembro da Revista ESPN, a trama envolvendo o amistoso da seleção contra os portugueses e os negócios obscuros entre a CBF e a agência é "digna de um folhetim" e tem "todos os ingredientes: poder, dinheiro e negócio realizados na penumbra", diz o texto.

Oficialmente, os sócios da empresa são Honigman, o empresário Sandro Rosell (atual presidente do Barcelona e ex-presidente da Nike no Brasil) e Vanessa Almeida Precht (ex-secretária do mandatário do Barça). Os dois primeiros são amigos próximos de Teixeira. "Cláudio me disse que os três eram sócios da Brasil 100%. Sandro e Cláudio iam sempre até Ricardo para mostrar os projetos. Eu estava presente nisto", revelou Nathalie à reportagem.

"Era muito comum, todos sabíamos que os três eram sócios. Inclusive juntos fizeram o projeto de como seria o logo da empresa. Nosso motorista ia constantemente à residência de Ricardo Teixeira para deixar todo tipo de documento relacionado à empresa. O interessante é que tudo é claro como água, mas por razões óbvias ninguém abre a boca com o que sabe", diz Nathalie. "Recordo de perguntar para os outros (sobre a condição oculta do sócio), mas Cláudio me disse que não poderiam sair como donos. Isso era muito claro, inclusive no círculo de amigos que não tinham nada a ver com futebol."

A reportagem da Revista ESPN tentou ouvir Ricardo Teixeira a respeito das declarações de Nathalie, mas o diretor de comunicação da CBF, Rodrigo Paiva, afirmou que o dirigente "não vai se pronunciar sobre isso se não existe nenhum documento oficial sobre o assunto".

A existência do possível "sócio oculto" já foi abordada na Justiça, diz a reportagem. No dia 13 de junho de 2010, o ex-contador da Brasil 100% Marketing, Jason de Oliveira Lima, convocado a depor no processo de separação de Nathalie e Honigman, foi questionado sobre a participação de Ricardo Teixeira na empresa. Oito meses após a assinatura do convênio milionário, e mais de quatro meses depois da liberação do dinheiro, o cadastramento ainda não saiu do papel, conforme revelou reportagem do Estado publicada ontem.

Em nota divulgada ontem à noite, depois das cobranças por explicações feitas pela Controladoria-Geral da União (CGU) e políticos da oposição, a assessoria do ministro Orlando Silva informou que convocara para hoje reunião com a entidade dirigida por cartolas. A reunião se destina a 'examinar com a entidade a continuidade do convênio e as condições da sua execução'.

Em entrevista ao Estado, o presidente do Sindicato, Mustafá Contursi, informou que a entidade ainda analisa a capacidade operacional do cadastramento. O próprio sindicato havia atestado sua capacidade para tocar o convênio, questão posta em dúvida por parecer jurídico do ministério, datado de 14 de dezembro, duas semanas antes do fechamento do contrato.

A capacidade técnica e operacional da entidade foi avalizada pelo então assessor especial de futebol e atual Secretário Nacional de Futebol, Alcino Reis. O sindicato seria, segundo ele, o 'parceiro ideal' para o cadastramento dos cerca de 500 mil torcedores até março de 2012.

Embora esse cadastramento não tenha saído do papel, e se limite atualmente a um 'teste' da proposta em Curitiba, por técnicos não contratados, o Ministério do Esporte, nega em nota, que o projeto seja 'fantasma'. O ministério, também nega relação do projeto com a Copa do Mundo. Mas é um documento assinado por Alcino Reis que faz essa relação. 'O projeto traz em seu contexto que é preciso aproveitar a mobilização nacional para mudar o ambiente social, a cultura e o comportamento que existe em torno do futebol como uma ação de preparação do Brasil para a Copa do Mundo FIFA 2014', diz o texto.

Na nota, o ministério afirma ainda que o contrato não conste da matriz de responsabilidade, documento que reúne obras da Copa do Mundo, contrariando a versão do próprio secretário.

Suspeita. A CGU e os partidos da oposição fizeram ontem cobranças públicas ao ministro sobre o convênio. O ministro da CGU, Jorge Hage, enviou ofício a Orlando Silva solicitando esclarecimentos. Conforme revelou o Estado, as empresas citadas como responsáveis pelos serviços afirmam que nunca foram contratadas pela entidade dos cartolas (leia abaixo).

Segundo a CGU, após a análise da documentação que deve ser enviada pelo ministro do Esporte, o órgão de controle poderá pedir o bloqueio dos recursos ou a suspensão do convênio.

DEM, PPS e PSDB querem convocar o ministro para depor no Congresso. O líder do PSDB na Câmara, Duarte Nogueira (SP), vai protocolar também representação na Procuradoria-Geral da República e pedir auditoria especial do Tribunal de Contas da União. 'Há muito dinheiro envolvido e o Ministério do Esporte tem antecedentes de suspeitas de irregularidades em projetos, como o Segundo Tempo.'

'Esse ministro é assim mesmo: promete e não cumpre, e canaliza dinheiro para projetos de fachada. Tenho certeza que chegará ao Senado sem explicações', afirmou o senador Demóstenes Torres (DEM-GO).

Não entendo como se faz uma afirmação destas sobre um ministro, e tampouco não entendo como é que o dinheiro sai assim tão fácil. E muito menos não entendo porque o CGU e até mesmo a PF não tomam iniciativas de fiscalizar tais acontecimentos.

Talvez um dia nós poderemos ver isto desaparecer de nosso País.

O presidente da Confederação Brasileira de Futebol (CBF) e do Comitê Organizador da Copa do Mundo de 2014, Ricardo Teixeira, voltou a entrar na mira da emissora pública britânica BBC, uma das mais respeitadas do mundo. Segundo reportagem do jornalista Jamil Chade, publicada pelo jornal O Estado de São Paulo, a BBC leva ao ar nesta segunda-feira uma reportagem em que revela que Teixeira admitiu em audiências a juízes suíços, a existência de pagamento de propina na FIFA.

A investigação foi feita pelo jornalista britânico Andrew Jennings, que foi o entrevistado do programa Bola da Vez, na ESPN Brasil, no ano passado, e tem uma série de livros publicados sobre os nebulosos bastidores da FIFA.

Na reportagem da BBC, o cartola ainda teria dito que fechou acordo para barrar a publicação dessas informações pelo tribunal da cidade de Zug, na Suíça, no caso ISL. O programa também mostra que o acordo passou pelo ex-presidente da FIFA, o brasileiro João Havelange, diante de procuradores que investigavam suspeitas de pagamento de US$ 100 milhões em propinas na entidade máxima do futebol mundial.

O acordo, diz a BBC, teria sido fechado por Teixeira e Havelange com o atual presidente da FIFA, o suíço Joseph Blatter, candidato a mais uma reeleição este ano. O conteúdo da atração que a emissora britânica exibirá foi divulgado no domingo pela imprensa norueguesa.
Segundo o Estadão, nem Teixeira nem Havelange teriam aceitado responder à BBC diante das informações obtidas pela emissora.

Isso porque as partes envolvidas chegaram a um acordo e uma multa de US$ 5,5 milhões foi paga como punição, o que evitou a prisão dos suspeitos. Pela lei suíça, quando há um acordo os detalhes do processo são mantidos em sigilo.

Mas, segundo o programa Panorama, da BBC, audiências do tribunal com Teixeira e Havelange, no marco do processo, teriam revelado que de fato os dois cartolas confirmaram o pagamento da propina.

Questionado, Blatter declarou neste domingo no jornal suíço NZZ que as acusações que pesam sobre Teixeira não seriam crimes diante da lei suíça.

Com o time carioca, o contrato previa uma renda de US$ 80 milhões por 15 anos e permitiu a chegada do jogador Petkovic ao rubro-negro. Mas, logo depois, a empresa quebrou e os contratos foram suspensos.
